Andere (Vize-)Präsidentschaftskandidaten haben den Senatssitz erst nach erfolgreichem Wahlausgang abgegeben. Obama, Biden (als VP) und Harris um nur die letzten drei zu nennen. Es wäre zu hoffen, dass Cruz nicht in diese Kategorie fällt.

Es geht mir nicht darum wann genau er den Sitz abgibt, aber der Sitz wird gleichzeitig mit der nächsten Präsidentschaftswahl neu gewählt, von daher würde er den ganz automatisch verlieren falls er wirklich der Kandidat würde.

Und wie gesagt, bei der letzten Wahl hat er mit <2 Punkten Vorsprung gewonnen und das war bevor er öffentlich einen gewaltsamen Putschversuch unterstützt hat. Texas ist sicher lange nicht so "purple" wie es manche Optimisten gerne hätten, aber es eine deutlich weniger sichere Bank für Cruz & Konsorten als die "richtigen" Südstaaten.

Korrekt, da hat damals bei McCain(auf nen Militärstützpunkt irgendwo geboren) doch der Senat darüber abgestimmt, war aber rechtlich nicht bindend wenn ich mich richtig erinnere.

Da der Begriff in der Verfassung verwendet und nicht erklärt wird kann der Kongress da in der Tat auch nicht viel mehr machen als zu sagen "Also so sehen wir das..."
Wenn es jemals eine Streitfrage wäre könnte das nur über den Supreme Court klar entschieden werden (oder natürlich hypothetisch über einen Verfassungszusatz, aber das halte ich jetzt für eher unwahrscheinlich)
