| 49.) The United Kingdom remains committed to protecting North-South cooperation and to its guarantee of avoiding a hard border. Any future arrangements must be compatible with these overarching requirements. The United Kingdom's intention is to achieve these objectives through the overall EU-UK relationship. Should this not be possible, the United Kingdom will propose specific solutions to address the unique circumstances of the island of Ireland. In the absence of agreed solutions, the United Kingdom will maintain full alignment with those rules of the Internal Market and the Customs Union which, now or in the future, support North-South cooperation, the allisland economy and the protection of the 1998 Agreement.
50.) In the absence of agreed solutions, as set out in the previous paragraph, the United Kingdom will ensure that no new regulatory barriers develop between Northern Ireland and the rest of the United Kingdom, unless, consistent with the 1998 Agreement, the Northern Ireland Executive and Assembly agree that distinct arrangements are appropriate for Northern Ireland. In all circumstances, the United Kingdom will continue to ensure the same unfettered access for Northern Ireland's businesses to the whole of the United Kingdom internal market.

Theresa May to tell Ireland 'nothing is agreed' on terms of Brexit as row over deal intensifies >
| Theresa May will insist that “nothing is agreed until everything is agreed” on the terms of Brexit after the Irish government claimed that last week's preliminary deal is binding.
[...]
However, the Irish dispute may now overshadow discussions between EU leaders later this week. It was sparked when David Davis, the Brexit Secretary, insisted the deal guaranteeing no hard border was not "legally enforceable". The Irish government insisted that the agreement was "binding" and it would hold the UK "to account" on it. Brexit-supporting MPs are worried that the UK has already committed to "full alignment" with the EU on regulations and standards that impacted on Northern Ireland.
Mr Davis told BBC1's The Andrew Marr Show: "This was a statement of intent more than anything else. Much more a statement of intent than it was a legally enforceable thing."
| Remarks: This report is put forward with a view to the meeting of the European Council (Article 50) of 14-15 December 2017. Under the caveat that nothing is agreed until everything is agreed, [...] | |
| 46.
The commitments and principles outlined in this joint report will not predetermine the outcome of wider discussions on the future relationship between the European Union and the United Kingdom and are, as necessary, specific to the unique circumstances on the island of Ireland. They are made and must be upheld in all circumstances, irrespective of the nature of any future agreement between the European Union and United Kingdom.
| They don't need to veto it because they know she's lying.
The EU wants to make a deal. May wants to keep all the factions of the Tory party (and Murdoch and the Daily Mail) happy.
The only way she can do that is by lying, right up until the point where the EU puts the deal she's agreed to in front of her and says "sign or else." At that point the elaborate charade that the UK has any power, any say in its future relationship with the EU, comes crashing down and May has to admit that Brexit is a catastrophe.
The deal is a fudge that the EU is giving May because, why not? It's going to get what it wants at the end of the "negotiations" because it holds all the cards. It was always a fudge, and not just a finger of fudge but two big fistfuls of fudgey goodness.

| There is actually some value in spending a lot of time pretending it isn't a litany of concessions, and the rushing the entire litany on one single day, and then going back to pretending that no it isn't.
This demonstrably works to fool very many people into thinking there's hardly any concessions being made.

*klick*
| The government has been narrowly defeated in a key vote on its Brexit bill after a rebellion by Tory MPs.
In a blow to Prime Minister Theresa May, MPs voted to give Parliament a legal guarantee of a vote on the final Brexit deal struck with Brussels.
The government had argued this would jeopardise its chances of delivering a smooth departure from the EU.
Despite a last-minute attempt to offer concessions to rebels, an amendment to the bill was backed by 309 to 305.

EU to UK: You’re not special | Politico >
The UK wants ‘deep and special’ ties post-Brexit but the EU has other ideas.
| Looking ahead to discussions about the future relationship with the U.K., senior EU officials and diplomats are warning that the bloc has numerous partnerships, including trade agreements, with many countries, and Brussels has no intention of diminishing those arrangements by offering London a sweeter package. | |
| At the same time, EU officials are also stressing that “most-favored nation” (MFN) provisions in existing trade agreements, and in World Trade Organization rules, will preclude Brussels from offering the U.K. special benefits that it does not offer to other partners. No one in Brussels seems inclined to reopen trade talks on numerous fronts to accommodate some special post-Brexit arrangement with the British. | |
| Britain cannot expect or get a closer, deeper or more special relationship than the EU has with Switzerland and Norway. | |

David Davis attacks EU’s ‘damaging’ no-deal Brexit planning >
| David Davis has consulted lawyers over the EU’s preparations for a no-deal Brexit, claiming Brussels’ planning is harming British business and breaching the UK’s rights as a member state.
In a letter sent to Theresa May, UK prime minister, last month and seen by the Financial Times, the Brexit secretary pointed to EU “measures” that could jeopardise existing contracts or force British companies to decamp to the continent if the UK leaves the EU without a deal.
Mr Davis said in the letter that he would ask the European Commission to revise its guidance to business so it highlights the potential for a future transition and trade deal.
